Geological Data Act replaces Depositories Act

On 30 June 2020, the new Geological Data Act came into force and replaced the Depositories Act of 1934. This serves to permanently secure geological data and make it available to the public, and is exclusively applicable to data generated in the course of geological investigations.

The main objective of data collection is documentation with regard to the supply of raw materials (stones/earths/soil resources/drinking water). Data that go beyond purely geological information (i.e. essentially strata inventories) and serve the purpose of contaminated site investigation, i.e. results of chemical analysis and the resulting information on soil or groundwater contamination, are expressly not to be collected.

Strictly according to the law, all drillings are currently subject to notification and the data obtained must be automatically made available within four weeks after the drilling. In contrast to the previously applicable Deposit Act, the Länder can stipulate under §2 (5) GeolDG that data from boreholes, subsoil investigations and pile-driving core soundings that do not exceed a depth of 10 metres are exempt from the obligation to provide data. However, there are no concrete announcements for Lower Saxony yet. According to information from the LBEG, the current coordination will result in a state ordinance.
